These Terms govern your use of empoweredbyct.com and the ClaimTrack application (the “Service”), operated by Claimtrack, Inc. (“ClaimTrack,” “we,” “us”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy.
ClaimTrack is not a law firm
ClaimTrack does not provide legal advice and is not a substitute for a lawyer. The Service is a software tool that helps you organize information, understand the typical shape of a personal injury claim, estimate what similar claims are worth, and draft documents that you decide whether to use. No attorney-client relationship is formed by using the Service. Value estimates are informational, based on general patterns, and are not a promise of any outcome. Deadlines such as statutes of limitation vary by state and by the facts of your case; you are responsible for confirming and meeting them. If your situation is serious or unclear, consult a licensed attorney in your state.
Your account
- You must be at least 18 and able to enter a binding contract.
- You are responsible for keeping your login credentials secure and for all activity under your account.
- Provide accurate information. The quality of what the Service produces depends on what you put in.
Your content
You own the information and files you add to the Service. You grant us a limited license to store, process, and display that content solely to provide the Service to you, including sending relevant portions to the AI and infrastructure providers described in our Privacy Policy. You are responsible for having the right to upload what you upload.
AI-generated content
The Service uses artificial intelligence to summarize, suggest, and draft. AI output may be inaccurate, incomplete, or inappropriate for your situation. You must review anything the Service generates before relying on it or sending it to an insurer, medical provider, or anyone else. You, not ClaimTrack, are the author of any document you choose to send.
Subscriptions and payment
- Paid plans are billed in advance on a recurring basis (currently monthly) through Stripe at the price shown when you subscribe.
- Your subscription renews automatically until you cancel. You can cancel at any time from the Billing page; cancellation takes effect at the end of the current billing period, and you keep access until then.
- Fees are non-refundable except where required by law or where we choose to offer a refund.
- We may change prices with at least 30 days’ notice by email; changes apply at your next renewal.
Acceptable use
You agree not to:
- Use the Service to make false or fraudulent claims or statements to any insurer, court, or other party.
- Upload content you don’t have the right to share, or that is unlawful or harmful.
- Interfere with the Service, probe its security, or access it by automated means other than the interfaces we provide.
- Resell the Service or use it to provide legal services to others.
Termination
You may close your account at any time by emailing support@empoweredbyct.com. We may suspend or terminate accounts that violate these Terms or create risk for us or other users. After termination, we handle your data as described in the Privacy Policy. Export anything you need before closing your account.
Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL PRODUCE ANY PARTICULAR SETTLEMENT, RECOVERY, OR OUTCOME.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CLAIMTRACK WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST RECOVERY, LOST SETTLEMENT VALUE, OR MISSED DEADLINE, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR $100, WHICHEVER IS GREATER.
Indemnity
You will defend and indemnify ClaimTrack against claims arising from your content, your use of the Service, or your violation of these Terms or applicable law.
Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict of law rules. Any dispute will be resolved in the state or federal courts located in California, and you consent to their jurisdiction. Before filing, you agree to contact us and try in good faith to resolve the dispute informally for at least 30 days.
Changes to these Terms
We may update these Terms. We’ll post the new version here with a new effective date and notify you of material changes by email or in the Service. Continued use after the effective date means you accept the updated Terms.
